Article 176
Formation of Provincial Assembly
(1) Each Provincial Assembly shall have the following number of members:
(a) The member who will be the first to be elected to the House of Representatives from the respective province will be twice the number of members who will be elected according to the election system,
(b) The number of members to be maintained as per Clause (a) shall be 60% and the remaining 40% shall be elected by proportional election system.
(2) Constituencies will be established in accordance with the federal law on the basis of geography and population for member elections as per clause (a) of sub-section (1).
(3) Sixty percent of the members of the Provincial Assembly shall be elected according to the first-come, first-served election system and forty percent of the members shall be elected according to the proportional election system.
(4) The election of Provincial Assembly members according to sub-section (3) shall be conducted by secret ballot based on adult suffrage in accordance with the law.
(5) Every Nepali citizen living within the territory of the province who has reached the age of eighteen years shall have the right to vote in any one of the constituencies according to the law.
(6) When a political party nominates candidates for the Provincial Assembly elections to be held in accordance with the proportional election system, based on the population, women, Dalits, tribal tribes, Khas Aryas, Madhesi, Tharu, Muslims, backward areas, and minority communities will be represented on the basis of a closed list according to the federal law. . The geographical balance of the respective province should also be taken into consideration while giving candidature. Explanation: For the purposes of this section, "Khas Arya" means the Kshetri, Brahmin, Thakuri, Sannyasi (Dashanami) communities. (7) In accordance with sub-section (6), the political party shall make provision for the representation of persons with disabilities.
(8) If the term of the Provincial Assembly remains vacant for more than six months, such position shall be filled by the same process which was filled by the electoral system.
(9) Notwithstanding anything else written in this section, the representative in the provincial assemblyAt least one-third of the total number of members elected from each political party should be women. At the time of such election, if one-third of the members of a political party are not elected among the members elected in accordance with clause (a) of sub-section (1), then at least one-third of the total members to be elected to the Provincial Assembly by such political party shall be women. He should be elected as a member.
(10) Any person who has the right to vote in the election for members of the Provincial Assembly and who has attained the qualifications according to Article 178 shall be eligible to be a candidate from any constituency of the Province subject to the law. But the same person cannot be a candidate in more than one constituency at the same time.
(11) Other provisions related to the election of the Provincial Assembly shall be in accordance with the federal law.
